What you need to know

  1. If you proceed as a Home Mover, you and Balfour Beatty Homes shall be bound by the terms and conditions set out in this leaflet concerning the sale of your existing property (“Home Mover Agreement”), acceptance of these terms shall be confirmed in your Reservation Agreement.
  2. You agree to Balfour Beatty Homes appointing a nominated estate agent who will market and sell your existing property.
  3. Balfour Beatty Homes will nominate two estate agents who will provide a valuation of your property. Balfour Beatty Homes will forward in writing to the purchaser a value reflective of the two-valuations provided. (Copies of these valuation can be provided to the purchaser upon request). A 3rd valuation will be undertaken if there is discrepancy between the two valuations. The Purchaser has five working days to agree the valuation offered by Balfour Beatty Homes on their existing home in writing. Upon receipt of this instruction the plot will be removed from the open market.
  4. Balfour Beatty Homes agree to pay for the nominated estate agent’s commission or fee plus VAT and (in Scotland only) the Home Report for marketing and selling your existing property, provided you legally complete on the purchase of a new Balfour Beatty home.
  5. You agree not to instruct another estate agent to sell your existing property until your Home Mover Agreement has ended, that no party is currently negotiating to purchase your existing property and that no introduction has already been made by another party.
  6. In the event that any existing contract with your estate agents cannot be cancelled without penalty, or if there is a penalty for a joint agency, Balfour Beatty Homes will not be liable for such fees as we cannot be responsible for obligations contained in third party contracts. Please note that you will be liable for disinstructing your existing estate agent and for any abortive costs or dual agency fees according to your contract.
  7. You agree to allow reasonable access to your property for viewings and survey purposes and to co-operate fully with our nominated estate agents in their endeavours to market and sell your property.
  8. If an offer at or above the Agreed Valuation is not received within 6 weeks from the start of marketing, we reserve the right to re-market our available plot. You agree that Balfour Beatty Homes is not responsible for the acts or omissions of its nominated estate agent and makes no warranty that an acceptable offer for your existing property will be received.
  9. This offer is subject to the terms and conditions of your Reservation Agreement with us which explains the circumstances in which we may retain part of your Reservation Fee.
  10. We shall be entitled to recover the cost of the Home Report (in Scotland) and any marketing fee from you that has been paid/is due to be paid by us to the nominated estate agent where you decide:
    • not to proceed with marketing your property before the 6 week period referred to above has lapsed
    • not to accept an offer (at, or in excess of, the Agreed Valuation)
    • after entering into a Reservation Agreement, not to proceed with the purchase of your Balfour Beatty home for any reason other than not getting an offer at or in excess of the Agreed Valuation.
  11. This Home Mover Agreement shall automatically end if your Reservation Agreement is terminated or there is a material breach of these terms and conditions.
  12. Until receipt of your Home Mover application and agreement by Balfour Beatty Homes on the valuation of your existing property, Balfour Beatty Homes reserve the right to continue to market the plot on the open market. Balfour Beatty Homes may sell the plot to another party and will not be held liable for any costs incurred by the purchasers should the Home Mover application or agreement be declined by either party.
  13. Offer not available in conjunction with any other offer.
